Why we can publish this without being a registered investment adviser
Elnath Finance Academy is a publisher of financial news, research, and education — not an advisory firm. That is not a choice of words but the legal framework we operate under: the Investment Advisers Act contains a publisher's exclusion, and in Lowe v. SEC (1985) the Supreme Court set out three tests for it —
